Time for Renewing and Extending Work Permits
- To extend a work permit, the employer must submit an application for renewal to the labor, invalids, and social affairs department at least 5 days but no more than 45 days before the work permit expires, as specified.
- Within 3 working days from the date of receiving a complete renewal application, the labor, invalids, and social affairs department will issue the renewed work permit.
As we all know, a work permit is a document issued to foreigners working in Vietnam, with a specified duration, usually two years. If the foreign worker continues to work in Vietnam after two years, the employer must apply for a renewal of the work permit. The renewal period is similar to the initial application, not exceeding two years.
The conditions for issuing and renewing work permits are as follows:
- Having full civil legal capacity as prescribed by the law.
- Having suitable health for the job requirements.
- Being a manager, director, expert, or technical worker.
- Not having committed crimes or being subject to criminal prosecution under Vietnamese law and foreign laws.
- Approval by the competent state authority for employing foreign workers in writing.
The process of applying for a renewed work permit is divided into two cases:
- Extension of Work Permit: When the work permit is about to expire.
- Reissuance due to loss, misplacement, or damage.
A foreigner's work permit in Vietnam is equivalent to an identity card used to present to the relevant authorities. Without a work permit, foreigners can be deported from Vietnam, and the opportunity to return for work is nearly impossible.
Regarding the extension of the work permit, the required documents include:
- A written request for the issuance of a renewed work permit from the employer (using the provided form).
- 02 color photos (size 4cm x 6cm, with a white background, looking straight, with a bare head, without colored glasses), taken within the last 6 months from the date of application submission.
- The previously issued work permit.
- A health certificate or a medical examination report (valid for 12 months from the date of health examination to the date of application submission).
- One of the relevant documents related to the foreign worker.
Time for Renewing and Extending Work Permits
To renew a work permit, the application must be submitted at least 5 days but no more than 45 days before the work permit expires, as specified.
Within a 3-day working period from receiving the complete application, the labor, invalids, and social affairs department will issue the renewed work permit.
The law does not specify the number of times a work permit can be extended after it has expired. Therefore, foreign workers can work long-term in Vietnam by adhering to the specified time frame, applying for extensions at the labor, invalids, and social affairs department, and presenting reasons in cases where extensions are not granted.
